Terms of Service

Effective date: [add date before publishing] · Version 1.0 · NextJobStep Inc.

Before this goes live: Section 18 (governing law) and NextJobStep Inc.'s registered address in Section 1 both need a real value, I don't know which jurisdiction the company is actually incorporated in. Sections 15 and 16 (limitation of liability, indemnification) are the parts of this document that carry the most real risk if worded wrong, and are worth a genuine legal review before publishing.

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the platform operated by NextJobStep Inc. ("NextJobStep", "we", "us", "our"), registered at [add registered business address]. By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

Our Privacy Policy explains how we handle your data and is incorporated into these Terms by reference.

2. What NextJobStep provides

  • Self-Track — free application tracking, job feed, and related tools you use yourself
  • AI Apply — a paid service where matching and drafting are automated, and every application is reviewed by a person before submission
  • College Partnership — institutional access for verified college staff, governed additionally by a separate agreement with the institution

We may add, change, or discontinue features at any time. We'll try to give reasonable notice for changes that materially reduce what's available to you.

3. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you confirm the information you provide is accurate and that you meet this age requirement.

4. Your account

  • You're responsible for keeping your login credentials secure and for all activity under your account
  • One account per person, don't create accounts on someone else's behalf without authorisation
  • Tell us promptly if you believe your account has been accessed without your permission
  • You can delete your account at any time; see our Privacy Policy for what happens to your data when you do

5. Acceptable use

You agree not to:

  • Provide false information in your profile, applications, or to an employer through the Service
  • Attempt to bypass rate limits, security measures, or access controls
  • Scrape, reverse-engineer, or systematically extract data from the Service beyond your own account's normal use
  • Post fake job listings or misuse employer/job-poster privileges
  • Use the Service to harass, impersonate, or defraud anyone
  • Interfere with the normal operation of the Service or other users' access to it

We may suspend or terminate accounts that violate this section.

6. Your content

You retain ownership of the content you upload or provide, resumes, cover letters, profile details, portfolio links, and similar. By providing it, you grant NextJobStep a licence to store, process, and use that content solely to operate the Service for you, including generating match scores, tailoring applications under AI Apply, and displaying your profile where you've chosen to make it visible.

You're responsible for making sure content you upload doesn't infringe anyone else's rights and doesn't contain anything unlawful.

7. Job listing data

Job listings on the Service are sourced from publicly available postings and third-party job boards. We don't control, and can't guarantee the accuracy, completeness, or continued availability of, listings created by employers or fetched from external sources. If you track a job by its URL, certain listing details (company, title, description) may become a shared record visible to other users; your personal application to that listing is not shared. See our Privacy Policy for details.

8. AI Apply

If you use AI Apply, you authorise NextJobStep to search for, prepare, and submit job applications on your behalf, using the profile information and preferences you provide, with a person reviewing each application before it's sent. You're responsible for the accuracy of the information you give us, since it's used to represent you to employers. We aim for quality and relevance, but we don't control employer decisions and don't guarantee any application will result in an interview, offer, or hire.

9. Sponsorship history information

Sponsorship history shown on employer profiles reflects historical, publicly available or third-party sourced information, and is provided for informational purposes only. It is not legal or immigration advice, may not reflect an employer's current or future sponsorship practices, and should not be relied on as a guarantee that any specific employer will sponsor a visa. Always confirm sponsorship directly with an employer and, where relevant, seek independent immigration advice.

10. No guaranteed outcomes

NextJobStep helps you organise, track, and act on your job search. We do not guarantee that you will receive interviews, offers, employment, or visa sponsorship. Outcomes depend on factors outside our control, including employer decisions and immigration authorities.

11. College Partnership

If you're using the Service through your college's partnership with NextJobStep, your institution has its own agreement with us governing that relationship, including any data processing arrangement. These Terms still govern your individual use of the Service as a student.

12. Fees and payment

Self-Track is free for individual students. AI Apply and College Partnership involve fees agreed separately at signup or through your institution. Where fees apply, you'll be told the amount and billing terms before you're charged.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or where required by law, and will make reasonable efforts to notify you unless the situation requires immediate action.

14. Disclaimers

The Service is provided "as is" and "as available." We don't warrant that it will be uninterrupted, error-free, or that any specific result will be achieved. To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of liability

This section needs real legal drafting before publishing. Liability caps and exclusions are jurisdiction-specific and easy to get wrong in a way that either doesn't protect you or isn't enforceable, this isn't a section to finalise from a template.

[To be completed with legal input: the scope of liability NextJobStep accepts and excludes, any liability cap, and carve-outs required by law (which typically cannot be excluded even by contract, such as liability for fraud or, depending on jurisdiction, death or personal injury caused by negligence).]

16. Indemnification

You agree to indemnify NextJobStep against claims, losses, or damages arising from your breach of these Terms, your misuse of the Service, or content you provide, to the extent permitted by law.

17. Intellectual property

The Service, including its software, design, and NextJobStep's trademarks, is owned by NextJobStep Inc. and protected by intellectual property law. These Terms don't grant you any rights to our intellectual property beyond what's needed to use the Service as intended.

18. Governing law

[Confirm and add: the jurisdiction whose law governs these Terms, and where disputes would be resolved, this should match wherever NextJobStep Inc. is actually incorporated and/or where you intend to be able to enforce these Terms.]

19. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email or a notice on the Service before they take effect. Continuing to use the Service after that point means you accept the update.
